Terms of Sale

These Terms of Sale govern all purchases made through VoltéLift.com (the "Site") and apply to all orders placed by customers in the United States. By placing an order through the Site you agree to these Terms of Sale. Please read them carefully before completing your purchase.

These Terms of Sale should be read together with our Terms of Use, Privacy Policy, Shipping Policy, Return and Refund Policy, and Product Warranty, all of which are incorporated herein by reference.

You must be at least 18 years of age and a resident of the United States to purchase from VoltéLift.com. By placing an order you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.

We make every effort to display our products accurately on the Site including descriptions, images, and specifications. However we do not warrant that product descriptions or other content on the Site is accurate, complete, or error-free. Product images are for illustrative purposes only and may vary slightly from the actual product. If a product you receive is materially different from its description on the Site please contact us at support@voltelift.com.

All prices displayed on the Site are in United States dollars. Prices are subject to change at any time without notice. The price charged for your order will be the price displayed on the Site at the time you place your order.

Pricing Errors. We make every effort to ensure pricing on the Site is accurate. In the event of a pricing error we reserve the right to cancel any orders placed at the incorrect price. If your order is cancelled due to a pricing error we will notify you promptly and issue a full refund to your original payment method. We are not obligated to fulfill orders placed at an incorrect price.

VoltéLift is required by law to collect sales tax on orders shipped to states where we have a sales tax collection obligation. Applicable sales tax will be calculated and displayed at checkout based on your shipping address. Sales tax rates may vary by state and are subject to change.

Accepted Payment Methods. We accept the following payment methods:

• Major credit cards including Visa, Mastercard, American Express, and Discover
• Shop Pay
• Apple Pay
• Google Pay
• PayPal
• Shop Pay Installments and other buy now pay later options available at checkout

Payment Authorization. By providing your payment information you authorize VoltéLift to charge your payment method for the total amount of your order including applicable taxes and shipping charges. Your payment method will be charged when your order is placed.

Buy Now Pay Later. We offer installment payment options through Shop Pay Installments and similar services. Installment payment plans are subject to the terms and conditions of the applicable third party provider. VoltéLift is not responsible for the terms, conditions, or practices of any third party installment payment provider. Eligibility for installment payment plans is determined by the third party provider and is not guaranteed.

Payment Security. All payment transactions are processed securely by Shopify and our payment processors. We do not store your payment card information on our systems. All transactions are encrypted using SSL technology.

Placing an Order. When you place an order through the Site you are making an offer to purchase the product at the listed price. Placing an order does not constitute a binding contract.

Order Confirmation. Upon placing your order you will receive an automated order confirmation email acknowledging receipt of your order. This email is a confirmation that we have received your order request and does not constitute acceptance of your order or formation of a contract.

Order Acceptance. Your order is accepted and a binding contract is formed when we send you a shipping confirmation email confirming that your order has been shipped. We reserve the right to refuse or cancel any order at any time prior to shipment for any reason including but not limited to product unavailability, pricing errors, suspected fraud, or inability to verify payment.

Order Verification. We reserve the right to verify the information you provide when placing an order. We may contact you to confirm order details before processing or shipping your order.

We use automated fraud detection tools to protect against fraudulent orders. We reserve the right to cancel any order that our fraud detection systems flag as potentially fraudulent or where billing and shipping information cannot be verified. If your order is cancelled for this reason we will notify you and issue a full refund to your original payment method. If you believe your order was incorrectly flagged please contact us at support@voltelift.com.

By You. You may cancel or modify your order within 1 hour of placing it by contacting us immediately at support@voltelift.com with your order number. After 1 hour we cannot guarantee that changes or cancellations can be made as orders are processed quickly. Once your order has shipped it cannot be cancelled — please refer to our Return and Refund Policy if you wish to return your order after it has shipped.

By Us. We reserve the right to cancel any order at any time prior to shipment. If we cancel your order we will notify you promptly and issue a full refund to your original payment method.

From time to time we may offer promotional pricing, discount codes, or special offers. The following conditions apply to all promotions:

• Discount codes must be entered at checkout to be applied — we cannot apply discount codes retroactively after an order has been placed
• Limit one discount code per order and per customer unless otherwise stated
• Discount codes cannot be combined with other offers unless expressly stated
• Discount codes are non-transferable and have no cash value
• We reserve the right to modify or cancel any promotion at any time
• Promotions apply only to orders placed during the promotional period

Pre-Orders. From time to time we may offer products for pre-order before they are available for shipment. Pre-order products will be clearly identified on the Site. When you place a pre-order your payment method will be charged in full at the time of purchase. Pre-orders will ship when the product becomes available. If we are unable to fulfill your pre-order we will notify you and issue a full refund to your original payment method. You may cancel your pre-order at any time before it ships by contacting us at support@voltelift.com.

Backorder Deposits. Certain products may be available for purchase on backorder prior to availability. For backorder purchases VoltéLift will collect a deposit at the time of order as specified at checkout. Your payment method will be securely stored and the remaining balance will be charged automatically when your order is ready to ship. You will be notified by email before the remaining balance is charged. You may cancel your backorder at any time before shipment and receive a full refund of your deposit by contacting us at support@voltelift.com.

Waitlists. We may offer waitlists for products that are temporarily out of stock or not yet available. Joining a waitlist does not constitute a purchase and no payment is taken. When the product becomes available you will be notified and given the opportunity to place a normal order. Joining a waitlist does not guarantee product availability or a specific price.

All orders are subject to our Shipping Policy which is incorporated herein by reference. Please review our Shipping Policy for information about shipping methods, timeframes, costs, and restrictions.

All purchases are subject to our Return and Refund Policy which is incorporated herein by reference. Please review our Return and Refund Policy before placing your order.

All VoltéLift devices are covered by our 2-Year Limited Warranty which is incorporated herein by reference. Please review our Product Warranty for complete warranty terms and conditions.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW VOLTELIFT'S LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO A PURCHASE MADE THROUGH THE SITE SHALL NOT EXCEED THE PURCHASE PRICE YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. VOLTELIFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR PURCHASE.

These Terms of Sale are governed by and construed in accordance with the laws of the State of New York without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms of Sale shall be subject to the dispute resolution provisions set forth in our Terms of Use.

We reserve the right to modify these Terms of Sale at any time. Changes will be effective upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the updated Terms of Sale.
